Terms of Service
The agreement between you and nomosly when you use the Service. Please read it carefully.
Acceptance
By creating an account, generating an API key, or otherwise accessing the nomosly service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
Description of service
nomosly is a developer API for visual intelligence: face comparison, face detection, label detection, and text detection. The Service is exposed as HTTPS endpoints authenticated with customer-issued API keys, plus a web console for key and billing management.
Accounts & access
You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity that occurs under your account and your API keys. Notify us immediately at support@nomosly.com if you suspect unauthorized access.
Billing & payment
The Service is billed on a pay-per-use basis. Charges are calculated from the per-operation rates published on the pricing page and invoiced at the end of each monthly billing cycle. Payments are processed by a third-party merchant of record; the specific provider is disclosed in our Privacy Policy.
We may suspend access if an invoice remains unpaid past its due date. All charges are final except where required by applicable law or where we identify a billing error on our side.
Acceptable use
Your use of the Service must comply with our Acceptable Use Policy, which prohibits, among other things, processing biometric data without consent, illegal surveillance, targeting minors, and circumventing rate limits.
API keys
API keys grant access to the Service. You must not embed keys in client-side code, public repositories, or any publicly accessible location. We may revoke keys that we reasonably believe have been compromised or are being used in violation of these Terms.
Data & privacy
Images submitted to the Vision API are processed in real time and discarded as soon as we return a response. Usage metadata is retained for billing. Full details are in our Privacy Policy. You retain ownership of all content you submit; you grant us a limited license to process that content solely to provide the Service.
Intellectual property
The Service, including its software, branding, documentation, and underlying models, is the exclusive property of nomosly and its licensors. Nothing in these Terms transfers any intellectual property rights to you beyond the limited right to use the Service as documented.
Service availability
Our availability target and remedies are described in the Service Level Agreement. We do not guarantee that the Service will be uninterrupted or error-free.
No warranty
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. nomosly does not warrant that any output of the Vision API (face matches, detected labels, extracted text) will be accurate, complete, or fit for a particular decision. You are responsible for human review where the consequences of an error are material.
Limitation of liability
To the maximum extent permitted by applicable law, nomosly shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or use, arising from or related to your use of the Service. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
Indemnification
You agree to indemnify and hold nomosly harmless from any claim, loss, or demand (including reasonable attorneys' fees) arising from (i) your use of the Service in violation of these Terms or applicable law, (ii) content you submit to the Service, or (iii) your failure to obtain required consent for biometric or personal data you process through the Service.
Termination
You may close your account at any time from the billing portal. We may suspend or terminate your account if you violate these Terms, fail to pay an invoice when due, or engage in activity that materially harms the Service or other customers. Outstanding charges remain due upon termination. Sections that by their nature should survive (intellectual property, warranty disclaimers, liability limits, indemnification, governing law) survive termination.
Force majeure
Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including natural disasters, internet or power outages, government actions, or third-party infrastructure failures (including AWS regional outages).
Changes to these terms
We may update these Terms as the Service evolves. Material changes will be communicated by email to active customers and posted to this page with an updated effective date at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
Governing law
These Terms are governed by the laws of the jurisdiction in which nomosly is organized, without regard to conflict-of-law principles. The parties consent to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising from these Terms.
